Welcome to Noirajya.com (“we,” “our,” “us”). By using our website, mobile app, or any of our services (“Platform”), you agree to these Terms of Service. Please read them carefully.

1. What We Do

• We provide a platform where local shops (“Vendors”) can create profiles and list their products or services.
• Customers (“Users”) can search for nearby shops and place orders directly with them.
• We do not sell, deliver, or guarantee any products. All orders, payments, and deliveries are handled directly by the shops.

2. Who Can Use the Platform

• You must be at least 18 years old to create an account or place an order.
• By using the Platform, you confirm that the information you provide is correct.

3. For Customers

• All payments are Cash on Delivery (COD), paid directly to the shop.
• Shops can charge additional fees like Delivery Fees which is not included during checkout. Delivery Fees if charged by the Shop would be mentioned on the Shop profile.
• If you have a problem with your order (quality, late delivery, missing items, etc.), please contact the shop directly.
• We are not responsible for refunds, cancellations, or disputes.

4. For Shops (Vendors)

• You are responsible for:
  • Keeping your shop profile, prices, and product details accurate.
  • Mentioning your shop registration numbers, license numbers and additional charges like delivery fees.
  • Ensuring product quality and timely delivery.
  • Handling all customer questions, complaints, and refunds.
• You must pay a subscription fee to keep your profile active.
• You can charge additional fees like Delivery Fees which is not included during checkout. Delivery Fees if charged by the Shop would be mentioned on the Shop profile.
• You cannot list illegal, harmful, or restricted items (see Prohibited Products Policy).

5. Our Rights

• We may suspend or remove any User or Vendor account that breaks these Terms.
• We may update or change the Platform features at any time.
• We do not promise that the Platform will always be available without interruptions.

6. Fees & Payments

• Vendors must pay the monthly subscription fee on time to keep their profile active.
• We do not charge commission on orders.

7. Limitation of Responsibility

• We are not responsible for:
  • Product quality, delivery issues, or wrong pricing.
  • Refunds, cancellations, or disputes between Users and Vendors.
  • Any loss, damage, or issues caused by using the Platform.
• We only provide the digital space where shops and customers can connect.

8. Ownership & Content

• Our Platform, logo, and design belong to us.
• Vendors own their shop content but allow us to display it on the Platform.
• Users and Vendors cannot copy, misuse, or share Platform content without permission.

9. Privacy

• Your information is handled according to our Privacy Policy.

10. Legal Matters

• These Terms are governed by the laws of India.
• Any disputes will be handled in the courts of Coochbehar, West Bengal, India.
